Virginia farmer trademarked flour with his name in 1772.
In 1772, a Virginia farmer petitioned the Fairfax County court to allow him to use his name as a trademark for flour. His request was granted. The farmer later became our first President.

 


Sellers of goods throughout the ages have put their names on things they produced. Some producers devised symbols or pictures to identify and distinguish their products. Before the 20th century, trademarks were usually symbols or pictures rather than words. Under the common law in each state, a seller who uses any symbol as a trademark acquires the legal right to prevent other sellers from using a similar mark. Many sellers federally register their trademarks for extra protection.

Congress provided a nationwide register of trademarks for sellers who participate in interstate commerce with the federal Lanham Act, enacted in 1946. Intent-To-Use Application

Definition:
Since 1989 in the United States, an optional method of applying for federal registration of a trademark based on a declared intention to use the mark on specific goods or services.

Current Filing Basis

Definition:
In applications under §§1 and 44 of the Trademark Act, the applicant may claim more than one basis, and may add or substitute a basis after filing the application.

Final Data Capture

Definition:
Once the fee, any correspondence, and/or drawings are matched with the application and all requirements have been met for issuance as a patent, the application is then forwarded to the Final Data Capture (FDC) stage of the process.
